GOVERNING DOCUMENTS

An Association’s governing documents may consist of CC&Rs, By Laws, Rules & Regulations, Election Rules, Architectural Guidelines, and a Condo Plan. These documents include restrictions, requirements, policies and procedures that impact the everyday operation of an Association. Oftentimes, those provisions are ambiguous, outdated, illegal or inadequate to address changing circumstances within the Association. Our clients turn to us to amend the governing documents. We have drafted new and amended CC&Rs, bylaws, rules & regulations, license agreements and operating rule amendments that have addressed rental restrictions, board elections and governance, maintenance responsibilities, solar panels, electric charging stations, artificial grass, dispute resolution procedures, and outdated laws and code references. We assist our clients with the preparation of the amended documents, letters explaining the changes to owners and the process and procedure for enacting the amended documents.
